Fiji rapist to be re-sentenced

A former Fiji police inspector is to be resentenced after his orginal rape sentence was quashed by the High Court.

He was originally sentenced to eight years in prison by the Nasinu magistrate's court but it also ruled that he would be free from Sunday night until Friday night.

The State appealed the sentence on the grounds the Magistrate erred in law in imposing the sentence on the 33 year old who raped his 22 year old sister.

FBC News reports that while hearing the State's appeal, Justice Paul Madigan said the facts and circumstances warrant a sentence of at least 12 years and the Magistrate should have used his powers to transfer the accused to the High Court.

The case will now be called before Justice Paul Madigan on July the 15th for the parties to make sentencing submissions and to address him in mitigation.
