Anti-fluoride group granted Supreme Court appeal

8:32 pm on 21 February 2017

A group opposing the fluoridation of South Taranaki's water supply has been granted a hearing in the Supreme Court.

New Health took legal action against the South Taranaki District Council, claiming it had no right to add fluoride to water supplies, and doing so was a breach of the Bill of Rights Act.

Last year the Court of Appeal ruled the proposal to fluoridate the water in Patea and Waverley was lawful, and fluoride was not a medicine when added to water supplies.

The Supreme Court today granted New Health the chance to appeal against that decision.

However, the court noted that if the government passed legislation relating to the fluoridation of water supplies nationally, it may reconsider that decision.
