Seasonal worker ruling 'could set precedent'

A court decision in favour of a long-term seasonal worker who was dismissed could have ramifications for others on similar contracts, according to an employment lawyer.

The Employment Court has ruled that seasonal work is a form of fixed-term employment.

It heard the case of Lynette Turner who had been working almost continuously for Talley's fish processing plant in Motueka for 10 years when she was told there was no more work.

The court ruled she had effectively been working on an indefinite basis and had the right to keep working at the plant.

Lawyer Max Whitehead says this decision will open the door for seasonal workers to challenge their bosses if a fixed term is not defined in their contract.

Talley's says it's considering the verdict but will continue its current employment practices.
