Mr Duke had gone to the Environment Court to appeal against Auckland Council's decision to allow only three landings and takeoffs a week.

Neighbours had expressed noise and safety concerns.

Mr Duke's lawyer filed a memorandum with the court on Friday withdrawing the appeal against the consent conditions, the council said.

The council had now closed the file.

Mr Duke and wife Patricia are building a mansion on Sarsfield Street in Herne Bay.

They have consent from the Auckland Council to transform the boat shed at the property, which overlooks the popular Sentinel Beach Reserve, into a helicopter pad.

Mr Duke had said he needed to use a helicopter up to six times a week so he could fly to golf and show visitors around the city.
