A father who says his daughter's rights were breached by a religious school programme will get his day in court, provided he meets conditions set by the Court of Appeal.
Jeff McClintock says Red Beach School's Board of Trustees has tried to hide the religious nature of a programme offered to students.
His daughter was treated unfairly when he chose to withdraw her from the programme, he said.
His legal action was struck out, but he's taken the case to the Court of Appeal.
In a judgement today, the court found Mr McClintock's lawyer missed deadlines despite extensions, calling the omissions serious and unexplained.
But it's found the case should be re-instated, provided Mr McClintock meets conditions, including dropping the case against the school and putting a case against the Attorney General instead.
