The Crown is to challenge the sentence given to the killer of a Palmerston North child.
Cash McKinnon, who was aged three years, died in August 2009 from head injuries sustained when her mother's former partner swung her around by the ankles to punish her for throwing a toilet roll in the toilet.
In March, Sean Donnelly, 23, was sentenced in the High Court in Palmerston North to seven years in prison for manslaughter.
The Crown sought a minimum term of imprisonment, but Justice Mackenzie declined to impose one.
After the trial, the Sensible Sentencing Trust demanded the Crown appeal against the sentence, saying it was pathetic.
The Solicitor-General's office describes the term as manifestly inadequate and has confirmed it will challenge the sentence in the Court of Appeal.
