The Court of Appeal has confirmed Nai Yin Xue - who was convicted of murdering his wife and leaving her body in a car boot in Auckland in September 2007 - has dropped an appeal against the conviction.

Xue is serving a life sentence in prison with a minimum non-parole period of 12 years.

He was apprehended in Atlanta in the United States on 28 February, 2008, after security footage showed him abandoning his three-year-old daughter in a train station in Melbourne, Australia, on 15 September, 2007.

It is understood the appeal was based on a decision by the judge that allowed jurors to stay at their own homes while considering their verdict in the case.

Xue's lawyer had previously questioned comments made by the judge during sentencing.
