A man charged over the stabbing of two people at a West Auckland dairy earlier this month has died in police custody.

The assault on a couple who own a dairy in New Windsor on 5 October left them hospitalised, with the man in critical condition.

The man was arrested and faced two charges of wounding with intent to cause grievous bodily harm and was due to appear in Auckland District Court today.

His lawyer, Ben Bosomworth, told the court that his client had died in custody and that he had been talking to Crown Law about withdrawing the charges.

Earlier this month, police said a number of people were in the shop at the time of the attack and they managed to intervene and restrain the offender.

The court expects to hear the application to withdraw the charges next month.

The Independent Police Conduct Authority said it was investigating.
