Cricketer on trial for rape charge

A professional cricketer has gone on trial in the Hamilton District Court on a charge of rape.

Scott Kuggeleijn, 24, plays for the Northern Knights based in Hamilton.

He has pleaded not guilty to a charge of sexual violation by rape in May last year.

The Crown said the defendant met the alleged victim, who is 21, at a party and later the two went to the woman's flat.

It claimed the two became intimate in bed and while the defendant indicated he wanted sexual intercourse, the alleged victim made it clear numerous times she did not.

The Crown said physical intimacy continued until the two fell asleep but on awakening the defendant got on top of the woman, held her arms above her head and penetrated her.

The Crown said the woman had the right to decide where it the intimacy would end.

The defence said Mr Kuggeleijn believed there was consent and had reasonable grounds to think so.
