Third strike ruling would be 'manifestly unjust'

An Auckland man has avoided being sent to prison for life with no parole under the three-strikes law.

At the High Court in Auckland this morning Ben Bosch Herkt was sentenced to life in prison with a minimum non-parole period of 12 years for the murder of Matthew Greenslade in Papakura in 2014.

He had repeatedly stabbed Mr Greenslade after a drinking session.

Crown lawyers had requested he be sentenced to life without parole under the three-strikes law but Justice Moore ruled that would have been manifestly unjust to Herkt.
