The lawyer for a Wellington businesswoman caught up in a David versus Goliath trademark battle against a Dutch GPS company says the company is acting inappropriately.
Gaylene Hosking, who set up Tom Tom Communications in 1998, is challenging the right of the GPS company TomTom to sell its devices in New Zealand under the same name.
She is seeking a definitive ruling that she owns the Tom Tom name in New Zealand
The Dutch company has applied twice to register the name in New Zealand, but failed.
It is now applying a third time, forcing Ms Hosking into another legal challenge.
Ms Hosking's lawyer Earl Gray said Tom Tom Communications has been established here since 1998.
Mr Gray said the multinational company was acting inappropriately by trying to use the name here.
