A juror who refused to swear an oath has been told he can't appeal against his conviction for contempt of court.
James McAllister's application has been denied by the Court of Appeal.
McAllister told a judge he didn't believe he could be impartial, when he was selected for jury service at Auckland District Court in July last year.
The engineering consultant also said he was too busy to take part, due to work commitments.
He was originally jailed for 10 days, but appealed against the sentence, which was changed to a $750 fine.
He also asked to appeal against the conviction but that was also declined by the Court of Appeal.
Justice Ellen France said McAllister's oath refusal was a way to get out of serving, and not about his ability to serve, and that by any test, his actions were in contempt.
