The man charged with assaulting international cricketer Jesse Ryder in Christchurch last year wants the case against him dropped.
The 38-year-old builder has name suppression and made the appeal in the Christchurch District Court on Tuesday.
He is charged with injuring with reckless intent after an altercation at a bar in the suburb of Merivale left Ryder in hospital in an induced coma.
The accused's lawyer Jonathan Eaton, QC, applied for a stay in proceedings because of the pre-trial publicity surrounding the alleged assault.
Judge Brian Callaghan reserved his decision.
