A man charged with stabbing a police officer in the face will be assessed by two medical experts to see if he is fit to stand trial.
Brett Mann appeared at the Auckland District Court on Monday, where Judge David Harvey found that, on the balance of probabilities, the 38-year-old had attacked an officer on 7 October this year.
The legal test is the first part of the process for determining whether or not a person is mentally fit to take part in a trial.
Judge Harvey said Constable Todd Martin and his colleague were responding to a complaint about a man threatening people when they found Mr Mann near an old gun implacement at Orakei.
He said Mr Mann pulled out a blade without warning and stabbed Mr Mann in the face, piercing his nasal cavity.
He said Mr Mann is also alleged to have threatened other officers with a chisel a short time later.
Judge Harvey said he will hear evidence about Mr Mann's mental health from two doctors when the case is recalled in February next year.
