Court rejects Denniston mine appeal

The Court of Appeal has dismissed an appeal by environmental group Forest and Bird in its bid to stop an open-cast coal mine on the Denniston Plateau on the West Coast.

Buller Coal has applied for resource consents for the open-cast coal mine - a move the society has tried to stop through the courts.

Forest and Bird applied for special leave to the Court of Appeal after the High Court dismissed its appeal against an earlier decision of the Environment Court.

In the Court of Appeal judgement, Justice O'Regan said the court was declining the leave to appeal, as it did not believe there was any proper basis for a further appeal.
