Bain judicial review to be heard in Auckland

David Bain has won the right to have his case against the Justice Minister heard in Auckland.

Mr Bain spent 13 years in prison for murdering five members of his family before being found not guilty in a retrial in 2009.

Earlier this year, he sought a judicial review of the way the minister handled his compensation application, claiming a breach of natural justice.

Mr Bain's lawyers argued that the review should take place in Auckland, because they couldn't afford for the case to be heard in Wellington, but the Crown opposed that.

Justice Keane ruled on Tuesday that the review will be heard in Auckland. It has been pencilled in for July.
