Court action by prisoner viewed as vexatious

A lawyer acting for Wellington District Court says legal action taken against the Crown by a prisoner jailed for murdering his wife is vexatious and an abuse of process.

Since being given a life sentence in 2000 for the murder of his wife Sandra, John Ericson has filed many proceedings challenging his conviction.

His latest challenge involves accusing two senior prison officers of conspiring to pervert the course of justice, by destroying material removed from his cell and failing to disclose relevant information to him.

Crown lawyer David Soper told the High Court in Wellington on Friday the case should be thrown out as a District Court judge acted correctly when he refused to issue summonses for those charges.

Ericson said the judge made his decision in chambers without considering all the relevant material, in a bid to protect the Crown.

Justice Goddard reserved her decision.
