The American Samoan Attorney General, Talauega Eleasalo Ale, says funding needs to be identified for plans to drug test government workers.
The bill says a substance abuse test will only be required if the employer has made a conditional job offer to the applicant, and suspects the person maybe under the influence of drugs or alcohol.
A second condition prompting tests would be if the worker had allegedly violated work rules prohibiting the use, possession, sale or transfer of drugs or alcohol while at work or operating machinery.
Testifying on the bill the Attorney General says it provides adequate protections for a person's rights but it lacks a funding source.
He also suggests it could be narrowed to require only certain agencies and positions, for example police,immigration and customs to undergo testing.
