A Nauru MP will have to wait at least another month for a Supreme Court hearing challenging the legality of the government's seizure of his passport.
Roland Kun, who has been suspended from parliament since May last year, was removed from a flight two months ago and had his passport cancelled amid accusations he was involved in anti-government protests.
His protracted fight for the return of his passport has been hampered by the lack of proper legal representation with the Government blocking him from using his Australian based lawyer.
In a court hearing this week Mr Kun was directed to re-submit his appeal naming the Minister of Justice as the respondent, rather than the Secretary of Justice, and this is adding to the delay with a probable court date now set for the 23rd September.
Mr Kun has been prevented from returning to his family who live in New Zealand because he has no travel document.
