Fiji board could face fresh legal action in tender row

The Fiji Government's Major Tenders Board could face fresh legal action after it awarded the Public Service Broadcasting contract to a private operator.

The ruling has since been overturned by Justice Jitoko, following an appeal by Fiji Broadcasting Communications Limited, and new tenders have been called for.

The Chief Executive of the FBCL, Francis Herman, says he is considering taking further legal action against the Board.

"As far as we're concerned, we were the only tender that satisfied the requirements of the tender procedures and documents, and therefore we should have been the only ones considered. Now that there is a kerfuffle over the accepting of a non-conforming tender, and, the court has ordered that we go back and tender, we feel very aggrieved by that."

Francis Herman says the ruling handed down by Judge Jitoko points out the Board considered applications which were not acceptable under the clear guidelines.
