In Wellington's Shelly Bay police have been speaking to a small group of protesters who've been served with eviction notices.
The City Council last night said there were unsafe levels of asbestos contamination, and was closing the land.
But a group of councillors - including the mayor - stopped council officers from taking that action.
The occupiers - Mau Whenua - are refusing to budge.
Meanwhile, the developer also wants them gone so construction can begin.
