A man prosecuting ACT Party leader John Banks over alleged electoral fraud wants the head of Sky City and internet entrepreneur Kim Dotcom to give evidence against the politician.
The Epsom MP is denying an allegation of electoral fraud relating to his Auckland mayoralty campaign in 2010.
The case is being brought by retired Wellington accountant Graham McCready over $65,000 of donations from Mr Dotcom and SkyCity.
Mr McCready told the Auckland District Court he needs more information from six people in order to progress the case to trial.
They include: Mr Dotcom, his lawyer and bodyguard, the boss of SkyCity, the Auckland electoral officer and the police officer who investigated.
When questioned by Judge Paul about whether those people wanted to give evidence, Mr McCready said they wouldn't - unless subpoenaed.
Mr Banks' lawyer, David Jones QC, opposes the move saying Mr McCready is just fishing for information.
Mr Jones described the case against his client as fundamentally flawed.
Judge Paul has reserved his decision.
