Aotea Square papers have to be served again

Auckland Council made mistakes in the way it served documents on Occupy Auckland protestors and will have to repeat the process.

Dozens of protestors were forced out of Aotea Square using bylaw legislation, but the council is taking court action to clarify what will happen if they return.

Eight protestors were ordered to the Auckland District Court on Wednesday to explain why they should not be imprisoned or fined if they set up camp again in the square.

But the judge said enforcement documents needed to be served on each of the eight individually - something that had not happened in all cases.

He adjourned the case for three months so the council can serve the papers again.

A wider argument on whether outstanding trespass notices are valid will be heard in the High Court at Auckland next week.
