Family to sue police for wrongful arrest

3:48 pm on 25 October 2010

The son-in-law of a woman wrongly arrested after an arson of a Tokoroa pre-school says he will sue police over her detention.

Tokoroa JP Mii Teokotai was charged with conspiracy to commit arson in 2005, but the charges were later dismissed due to lack of evidence.

Another woman was later sentenced to prison for the matter.

The Independent Police Conduct Authority has criticised the handling of the case by police, saying the arrest was unjustified and based on hearsay evidence.

Mrs Teokotai's son-in-law, Dave White, says he will file a civil claim against police seeking redress for wrongful arrest, illegal detention, humiliation and loss.

Mr White says Mrs Teokotai lost her job as a result of their actions and has not yet received an apology from police over the way she was treated.

He hopes to have the claim filed in the Rotorua High Court by Christmas.
