Accused baby killer guilty of murder - Crown

The Crown in the trial of a woman accused of leaving her baby alone in a deep bath to drown says she is guilty of murder, not infanticide.

The woman, 29, who has name suppression, is charged with the murder of her 13-month-old son in Auckland in November 2009.

The jury of 11 women and one man in High Court at Auckland also have the alternative and rarely laid charge of infanticide to consider.

The defence has said the woman, who was severely depressed, went to make her daughter breakfast and forgot about the boy.

The defence said it is not conclusive as to whether the boy drowned, or died of pneumonia, which he had at the time.

In its closing address on Friday, the Crown said the accused intended to let the baby die to make life easier for herself.
