Oranga Tamariki claims no right to detain 12-year-old who escaped

Oranga Tamariki says it did not have the legal authority to detain a 12-year-old boy charged over a robbery, who managed to escape its care three times in one week.

A youth court judge said it was "beggar's belief" the boy, who was under 24-hour curfew at a Hastings motel, was able to escape from a paid minder.

But the ministry said it could not stop the boy from leaving because of a particular section of the Oranga Tamariki Act which he was bailed under by a Justice of the Peace.

It said when the boy re-appeared in court, he was then remanded under a different section of the legislation, which gave it the ability to detain him.
