No charges over Auckland swimmer's death

Police will not lay charges over the death of an Auckland swimmer struck by a boat earlier this year.

Westlake High School teacher Leslie Gelberger's body was found in Auckland Harbour near Mairangi Bay in April.

Police began an investigation after it was believed he was struck by a boat as he approached North Head.

Detective Inspector Aaron Pascoe said they had sought legal advice from Crown Law as to whether charges should be laid.

"Following this police have made the decision that there is insufficient evidence to file any criminal charges," they said.

Mr Gelberger's death will now be referred to Maritime New Zealand and the coroner.

"We have advised Leslie's family of this outcome and we continue to offer them support as they grieve the loss of much loved husband, father and family member," police said.

At the time of his death, Mr Gelberger's wife Laura McLeod said he loved the water but safety was also very important to him.

A fundraising page set up for her and their two sons, aged five and seven, raised over $50,000 dollars.
