Former state wards lose appeal

Two brothers who sought to sue the Government for abuse they say they suffered as children in state care, have lost their appeals.

The two men, now aged 49 and 51, had claimed $1 million each in damages for poor decisions by social workers, and physical and sexual abuse they suffered in institutions.

However, in a decision issued on Friday, the Court of Appeal upheld a High Court ruling that the claims fell outside time limits.

The men's lawyer had argued they could not pursue their claims earlier because they were so disabled by the damage they suffered as children.

However, the Court of Appeal found there was nothing to stop them taking legal action earlier.
