Nelson City Council is seeking legal advice on Telecom's plan to build a 22-metre-high cellphone tower beside a playcentre.
The Atawhai group on Thursday stepped up its fight against the tower asking the council for help, while in Wellington a parliamentary select committee has been hearing submissions on the issue.
The council believes Telecom has an existing site designation enabling it to build the tower without consent, but is seeking clarification from its lawyers.
Telecom says it is looking for an alternative site, although that cannot be guaranteed. It says it has undertaken not to build any tower in the area until 2009.
