Trial of Kumar accused postponed

Two boys accused of killing a west Auckland dairy owner will have to wait a further seven months for their trial.

One, a 13-year-old, denies charges of murder and assault with intent to rob. The other, who is 12, has been charged with manslaughter and assault with intent to rob and denies the charges.

Arun Kumar, 57, died in his Henderson dairy after being attacked on 10 June this year.

The High Court had wanted the case to be heard as soon as possible because of their age and the trial had been due to start next week, five months after Arun Kumar was found stabbed in his dairy.

However Justice Lang has postponed it and set a date in June next year.

In the High Court in Auckland this morning the judge said defence lawyers need to get evidence from expert witnesses and the November date was completely unrealistic. Justice Lang said the delay was not the fault of the lawyers.

The boys are in the care of Child Youth and Family.
