A former high-ranking navy officer whose convictions for not disclosing an affair with a subordinate were quashed will not face a retrial.
A spokesperson said for the Court Martial Appeal Court said Commodore Kevin Keat was no longer under the Defence Force's jurisdiction and was therefore not subject to its authority.
Commodore Keat was last year found guilty on five charges of breaching orders and dismissed from the navy.
His convictions were overturned on appeal in August.
His lawyer, Michael Bott, said his client was relieved and exhausted his nightmare was over.
However, he was still struggling financially since being dismissed.
"He's lost his rank, his reputation, and his career is effectively over," Mr Bott said.
"He remains without a job at this stage and his wife is having to work two part-time jobs to make ends meet."
The Defence Force has 28 days to appeal.
