Fonterra seeks stay in botulism case

Fonterra is asking the High Court to throw out a case brought against it for damages from last year's botulism scare.

The French company Danone is suing the dairy cooperative for losses it says were caused when potentially contaminated Fonterra milk powder was used in its products.

Fonterra's plan to stay the proceedings has been revealed in a High Court minute issued by Justice Brown.

A hearing was held on Wednesday to decide whether media will be allowed access to the court documents filed in the case.

Justice Brown ruled that none of the submissions made on Wednesday could be reported and reserved his decision on the documents .

Danone has previously said it wants $330 million in compensation but that that number may change.

Both companies are also involved in a confidential arbitration process, taking place in Singapore.
