Vehicle impounding loophole being examined

The Ministry of Transport is considering closing a legal loophole that prevents police impounding a person's car even after they are deemed medically unfit to drive.

The change is being investigated at the direction of the coroner who is concerned the police had not been able to seize the car of Ewen Donaldson, 87, who subsequently drove the wrong way on a motorway, killing himself and his wife.

Police told the coroner they would not have been able to impound the car because his driver's licence had already expired.

The ministry said work is underway to see how the rules can be altered, which may not necessarily involve a law change.
