Auckland International Airport Ltd says it will continue to fight to retain part of its land which the former owner is trying to get back.
The Craigie Trust, the original owner of the 36.4 hectares of land in dispute, believes the area is now surplus to airport requirements and should be offered back under the Public Works Act.
The airport company says the trust has indicated it intends appealing to the Supreme Court over a Court of Appeal decision that upheld a ruling in favour of Auckland Airport Ltd.
AIA says it is disappointed the trust is appealing further and it remains strongly of the view that the claim is without merit.
It says it will oppose the trust's application for leave to appeal and will strongly defend any appeal to the Supreme Court.
