A group of Waiheke residents who opposed a controversial marina development say they are delighted the Environment Court has rejected a consent application.
The court has ruled that if the proposed 112-berth marina were built in Matiatia Bay, next to the ferry terminal, the natural character of the area would not be protected.
The spokesperson for the residents' group Direction Matiatia, Merran Lawler said it was a convincing hands-down win which she believed the developer, Waiheke Marinas, was unlikely to appeal against.
"It was a very, very thorough decision which really addresses not just this marina, but why a marina in that location at all, ever, would be inappropriate."
The company could not be reached for comment.
