An expert opinion given to French Polynesia's administrative court suggests that it nullify a resolution passed by the assembly which seeks the territory's reinscription on the UN decolonisation list.
The court is due to rule next week and usually follows the advice.
The case was lodged by the opposition in Tahiti last August when it took issue with the assembly decision, claiming that in the voting process all basic rules were violated.
The pro-independence French Polynesian member of the French Senate, Richard Tuheiava, who is a lawyer, says his reading of the opinion is that the objection refers to one aspect only.
"The second article was just a request to the secretary-general of the United Nations Ban Ki-moon to put this issue on the agenda of the general assembly."
Richard Tuheiava says the legitimacy of the resolution is given because it had been both signed and voted by a majority of assembly members
