Supreme Court Judge in Samoa concerned over loss of offending records

A Supreme Court judge in Samoa is upset that records of previous convictions for offenders before the court for sentencing cannot be found.

Justice Vui Clarence Nelson said this is happening too often and has been going on for far too long.

He made the comments during a hearing where the prosecution was unable to provide the judge with a record of previous convictions for a defendant.

The judge said the court has been treating defendant as first time offenders when clearly they're not, because records of past convictions are not provided to the court.

He said this was unsatisfactory and suggested that the Attorney General write to the Commissioner of Police about the problem.
