The family of Niue MP Hunuki Hunukitama who died in hospital after collapsing at the Limu Reef pools in July have confirmed a formal complaint has been lodged with the police.
This follows a report to the Minister of health by a Filipino doctor who has since left the island.
It's alleged that the report casts doubt over the emergency treatment administered to Mr Hunukitama after he arrived at the hospital by ambulance.
The doctor's report sparked an inquiry conducted by the Niue Public Service Commission last week.
The inquiry team - consisting of the Premier's legal advisor, a public service inspector and a retired director of health - is expected to table its report to cabinet later this week.
An inquest scheduled to be held this week before Chief Justice Norman Smith acting as coroner was adjourned until February 2004 because the police have yet to complete their report on the matter.
