A retired federal judge in Australia says the government's policy of processing asylum seekers offshore amounts to bribing Nauru and Papua New Guinea into doing Australia's dirty work.
Marcus Einfeld also says offering asylum seekers money to return home missed the point - which was whether people qualified for refugee status or not because it was not safe to live in their country of origin.
Justice Einfeld says it's wrong to treat people as if they've done something wrong by coming to Australia.
And he says it shouldn't be activated by some feeling that Australians don't want Afghans because they're Muslims or they're wild.
He says if it is not safe to send them back to the place where they came from then the chances are they should be classified as refugees because that's the whole point of refugee status.
